On Wednesday, the Union Cabinet granted approval for amendments to the Goods and Services Tax (GST) laws, sanctioning the imposition of a 28% tax on the complete nominal value of bets within the realm of online gaming, casinos, and horse race clubs, as per insider sources.
The modifications to both the Central GST and Integrated GST acts, previously sanctioned by the GST Council during the preceding week, are expected to be introduced during the ongoing monsoon session of Parliament, concluding on August 11th.
During its 51st assembly on August 2nd, the GST Council recommended adjustments to Schedule III of the CGST Act of 2017, intending to provide lucidity concerning the taxation of provisions in casinos, horse racing, and online gaming. Furthermore, the Council proposed the inclusion of a clause in the IGST Act of 2017, imposing GST responsibility on online money gaming services furnished by foreign entities. Such entities would be mandated to acquire GST registration within India.
Additionally, provisions will be established to impede access to overseas-based online gaming platforms in instances of non-adherence to registration and tax settlement prerequisites.
The revised segments in the GST regulations, specifically delineating online gaming, online money gaming, virtual digital assets utilized for online game payments, and the entities pertinent to online gaming, are slated to be operational from October 1st, as reported by credible sources.

In its assembly on Wednesday, the Union Cabinet reportedly cleared the amendments to both CGST and IGST statutes. The Council, serving as the paramount decision-making body within the contemporary indirect tax framework, inclusive of the Union finance minister and state representatives, made a decision on August 2nd to apply a 28% GST rate to the face value of initial-level bets placed on gaming platforms and within casinos.
Subsequent to the Council meeting, Finance Minister Nirmala Sitharaman conveyed that the proposed adjustments to CGST and IGST would be introduced during the monsoon session of Parliament. States will undertake corresponding amendments to their respective State GST regulations within their assemblies.
Presently, the online gaming sector and certain horse racing clubs are subject to an 18% GST rate on platform fees or commissions, varying from 5% to 20% of the complete nominal value. Conversely, certain horse racing clubs adhere to a 28% tax on the total nominal value. Disputes regarding the 28% imposition on actionable claims in the form of betting and gambling are being pursued through legal avenues.
Casinos, too, are presently subjected to a 28% GST rate on their Gross Gaming Revenue. The imposition of a 28% GST on the total nominal value of initial-level bets is anticipated to generate augmented GST revenues.
